City of Fairhope SMS Terms of Service

Effective Date: August 2025

By opting in to receive SMS (text) messages from the City of Fairhope ("we," "us," or "our"), you agree to the following Terms of Service. Please read them carefully.

1. Program Description

The City of Fairhope may use SMS messaging to provide residents and subscribers with important updates, including but not limited to:

  • Emergency alerts
  • Public safety notices
  • City event reminders
  • Weather updates
  • Utility service information
  • General announcements

Message content will vary depending on your selected preferences, if applicable.

2. User Opt-In

By providing your mobile number and affirmatively opting in (e.g., through a form, text command, or checkbox), you consent to receive recurring SMS messages from the City of Fairhope. Consent to receive messages is not a condition of any City service.

3. Message Frequency

Message frequency will vary based on service area and message type. You may receive multiple messages per month depending on the urgency and nature of communications.

4. Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any message. You may also contact us directly to be removed from the list. After opting out, you will no longer receive SMS messages unless you re-enroll.

6. Cost and Fees

The City of Fairhope does not charge for SMS messaging services. However, message and data rates may apply depending on your wireless carrier and plan. Check with your carrier for details.

7. Supported Carriers

Our SMS service is supported by most major U.S. wireless carriers. The City of Fairhope is not responsible for any delays in message delivery or service issues caused by carriers.

8. Privacy

Your privacy is important to us. Personal information collected through the SMS service will be used in accordance with our Privacy Policy and will not be sold or shared for marketing purposes.

9. Disclaimer of Warranty and Limitation of Liability

SMS messages are provided on an "as-is" and "as-available" basis. The City of Fairhope does not guarantee:

  • That messages will be received or delivered timely
  • That the service will be error-free or uninterrupted

To the fullest extent permitted by law, the City of Fairhope is not liable for any damages arising from the use of this SMS service.

10. Changes to Terms

We reserve the right to modify or terminate the SMS program or these Terms of Service at any time. Updates will be posted to our website and will become effective immediately upon posting.
